Terms of Use
These terms are a contract between you and SAME Events (“SAME”, “we”, “us”). They cover the SAME Events app at app.same.events and the marketing site at same.events.
If you use SAME for a company, school, council, club, or other organisation, you agree to these terms for that organisation, and you confirm you have authority to bind it.
1. What SAME is
SAME is an event booking platform for South Australia. An organiser builds an event, then requests or quotes vendors around that event. At launch, vendors offer request to book and quote required. Instant book is not offered. Paying for the event service by card inside SAME is not offered.
SAME provides the software, the directory, and the workflow record. SAME is not the supplier of a vendor’s event service. The contract for a performance, workshop, hire, or other service is between the organiser and the vendor.
At launch, SAME does not collect, hold, or pay out money for that event service.
2. Who can join
You must be 18 or older, and able to enter a contract in Australia.
You must give a real name, a real email address, and accurate business details where we ask for them. You are responsible for your password and for what anyone does while signed in to your account.
3. Accounts and workspaces
A person has one user account. Work sits in a workspace.
- Personal. Free. For your own events, within the limits shown in the product (currently up to 3 active events).
- Organiser. Paid. For a business, school, OSHC service, council, club, or similar. Includes members and programme tools, within the limits shown in the product.
- Vendor. Paid. For a business that lists experiences and responds to requests.
Members of a workspace can see that workspace’s events, requests, quotes, and bookings, according to the role the owner gives them. You must only invite people who are allowed to see that information.
You may close a paid workspace from its settings when no rule in the product blocks closure. Closing a workspace does not by itself delete historical events, quotes, or bookings. Those records can still be needed by the other party and for tax.
We may suspend an account or workspace if you break these terms, if we reasonably believe the account is being misused, or if a charge for a subscription fails after the grace period described below. We will tell the workspace owner what happened and how to respond, unless the law stops us or the misuse is urgent (for example, fraud or a safety risk).
4. Subscriptions, cancellation, and refunds
This section is the contract for money you pay SAME. Personal use is free. An organiser workspace or a vendor workspace needs an active subscription, or an access grant we have issued, before the workspace can be created. If the product offers a trial on that screen, it states how many days the trial lasts. The trial ends on that date unless you start a paid plan.
- Renewal
- A paid workspace subscription renews automatically at the end of each billing period, at the standard price for that plan, until you cancel. We email workspace owners, managers, and admins before renewal. Annual plans are reminded 30 days before renewal. Every paid plan is reminded 14, 10, 7, and 3 days before renewal. Those emails are service messages.
- Monthly and annual billing
- Organiser workspaces are A$59 a month or A$590 a year. Vendor workspaces are A$49 a month or A$490 a year. You choose monthly or annual at checkout. Prices are in Australian dollars and are the amounts shown before you pay. Stripe issues the invoice for the subscription. A launch offer may reduce the first invoices for a limited number of new workspaces. The checkout screen shows that offer before you pay. An offer applies once per workspace. It does not apply twice if you switch between monthly and annual.
- Cancellation
- Cancel in the Stripe customer portal from Manage billing on the workspace. Cancellation takes effect at the end of the period you have already paid for. You keep paid features until then. Promotional or complimentary access ends on the date stated when it was granted. It does not roll into a paid plan unless you check out.
- Failed payments
- If a renewal charge fails, we email workspace owners, managers, and admins. You have 3 days to update the card. After that, paid features stop and we email again. Events, quotes, bookings, and other records stay in the workspace. You can still read them. You cannot create new paid activity until billing is current.
- Refunds
- We do not refund the unused part of a subscription period, except where the Australian Consumer Law requires a remedy, or where we agree in writing. There is no general cooling off right for an online subscription you requested. SAME does not collect the money for an event booking. A refund, deposit, or cancellation amount for that service is between the organiser and the vendor.
We may change subscription prices or the features included in a plan. For a current subscriber we will email the workspace owner at least 30 days before the change applies to a renewal. If you do not agree, cancel before the renewal date. The change does not apply to a period you have already paid for.
5. Organisers
You are responsible for the event: the date, the site, the headcount, the age range, access notes, and any rule your school, council, or insurer imposes.
When you send a request or accept a quote, you are asking that vendor to supply the service, or agreeing to their offer, on the details in SAME. Read the price, date, and what is included before you accept. The vendor’s price is the vendor’s price. SAME does not set it.
Exact site address, site access notes, and full phone and email of the other party stay hidden until a booking has started. Until then, vendors see suburb, state, and postcode.
6. Vendors
You supply your service as an independent business. SAME does not employ you, engage you as a worker, or guarantee any number of requests.
A published vendor profile and its experiences can be viewed on the public web without an account. Your listing, prices, travel fees, availability, and GST setting must be accurate. You issue your own tax invoice to the organiser for your service. A SAME booking receipt is not your tax invoice.
You are responsible for the licences, insurance, and checks your work requires. Uploading a document to SAME does not make SAME the screening agency, and it does not guarantee the document is current.
Accept a request only if you can do that date. If you cannot, decline. If you have accepted and then cannot attend, tell the organiser immediately and cancel in SAME. The organiser’s remedy for a service you do not deliver is with you, not with SAME.
7. Bookings and cancellations
A request, quote, or booking in SAME is a record of the deal between organiser and vendor. Status labels describe that record. They are not a payment guarantee.
Either party may cancel as the product allows. Cancellation does not move money inside SAME, because SAME is not holding the money. You agree the refund, deposit, or cancellation fee directly with the other party.
If you mark a booking paid in SAME, you are recording your own belief that money was paid outside SAME. That tick is not proof of payment and not a receipt from us.
8. Child safety
Programme fields ask for children counts and age ranges so a vendor can judge fit. Do not enter a child’s name, photo, or contact details unless you have a specific need and authority to do so.
SAME does not supervise children and does not replace your child safe policy.
9. Your content and acceptable use
You keep ownership of text, logos, and photos you upload. You give SAME a licence to host, display, and back up that material for as long as the product needs it to run the service. You confirm you have the right to upload what you upload, and that it is not unlawful or misleading.
You must not:
- use SAME to break the law, or to harm a child
- misrepresent your identity, qualifications, insurance, or prices
- scrape, probe, or overload the service
- upload malware, or attempt to access another workspace
- use the directory as a lead list for unrelated marketing
10. Privacy
Our Privacy Policy explains what we collect and who we share it with. It forms part of these terms.
11. Consumer guarantees and liability
For consumers, the Australian Consumer Law gives guarantees that cannot be excluded. For our own service (the software and the subscription), those guarantees include due care and skill, and fitness for a purpose you made known. Where the law allows a remedy, we will repair, resupply, or refund.
Nothing in these terms excludes, restricts, or modifies a right or remedy that cannot lawfully be excluded.
The event service itself is supplied by the vendor. Consumer guarantees for that service are the vendor’s responsibility.
To the extent the Australian Consumer Law allows, and not beyond it:
- SAME is not liable for a vendor’s act or omission, a cancelled performance, a site problem, or a payment that organiser and vendor made outside SAME.
- SAME is not liable for loss of profit, loss of a booking, or indirect loss, except where we caused it by a failure to take reasonable care, or where the law does not allow this limit.
- Where a contract guarantee can be limited for goods or services not of a kind ordinarily acquired for personal use, our liability for breach of that guarantee is limited to resupplying the subscription service or paying the cost of resupply.
We do not promise that SAME will be uninterrupted.
12. Changes, complaints, and law
We may update these terms as the product changes. If a change materially affects a paid workspace, we will email the owner at least 30 days before it applies, unless the change is required by law sooner. The new terms apply from the effective date on this page. If you do not agree, cancel the subscription before that date and stop using the paid workspace.
Email hello@same.events with your account email and what went wrong. We will acknowledge within 5 business days and aim to respond within 15 business days.
These terms are governed by the laws of South Australia and the Commonwealth of Australia. Courts of South Australia have non-exclusive jurisdiction.
